So: If others are doing something illegitimate or even illegal, then that's cause enough to exempt ISPs from rules that currently prevent them from doing the same thing…

That's like saying "Because somebody downstream can pollute the river, I should be able to pollute the river as well, so please change the law to allow me to…"
